Terms of use

Heavy Vehicle Marketplace (part of the NearMe network) is an Australian classifieds platform for trucks, trailers, machinery, buses, vans and heavy vehicle parts. By creating an account or using the site you agree to these terms.

The marketplace is a venue

Listings are created by sellers, and sales happen directly between buyer and seller. We are not a party to any sale, we do not hold stock, take commission, process the sale payment, or guarantee any item's condition, authenticity or fitness. Inspect before you pay; our safety guide explains how.

Accounts

You need an account to list parts or message sellers. Keep your login to yourself and give us accurate details. Business sellers who display a trading name must be entitled to use the ABN they enter. Launch business setup checks format and duplicate use but is not independent registry or ownership verification. We can suspend or close accounts that break these terms or the listing rules, and remove any listing that does.

Listings and fees

Free Private includes up to five active ads. Private Seller Plus is A$14.95 per month including GST for up to 25 active ads and the stated private-seller tools. Business seller accounts are unlimited and free at launch. A featured boost is A$9.95 for 30 days. There is no paid repost product. A paid benefit starts only after Stripe confirms successful payment. If Plus renewal payment fails, paid tools and capacity pause immediately without removing existing public ads; the seller may restore payment or reduce to the Free limit. A failed boost payment never starts or extends a boost. Refund rights under Australian Consumer Law remain.

Acceptable use

No unlawful, stolen, counterfeit or prohibited items (see the listing rules), no misleading listings, no harvesting other users' details, and no interfering with the service. Messages sent through the site must relate to buying and selling on it.

Encumbrance, write-offs and identity

Sellers must disclose money owing on a vehicle or machine, and must not advertise an encumbered unit as unencumbered. A vehicle recorded as a statutory or repairable write-off must be described as one. VIN, chassis, engine and serial numbers must be intact and must match the compliance plate and the seller's paperwork.

We do not search the Personal Property Securities Register, the written-off vehicle register or any stolen-goods register on your behalf, and a listing appearing here is not evidence that a unit is clear. Buyers should search the PPSR at ppsr.gov.au by VIN, chassis or serial number before paying, and where finance is owing should pay the financier the payout figure directly. A financier can repossess an encumbered unit from a buyer who has already paid the seller in full.

Compliance, roadworthiness and mass limits

Whether a vehicle or machine may lawfully be registered, driven, operated or worked is a matter between the seller, the buyer and the relevant road or workplace safety authority. Descriptions of roadworthy or safety certificate status, ADR compliance, registration, mass and dimension limits or plant registration are the seller's representations, not ours. Operators remain responsible for their own obligations under the Heavy Vehicle National Law, including chain of responsibility duties, in the state or territory where the unit is used.

Optional marketing

Marketing is never required to use the marketplace. At listing time you may separately opt in to relevant Heavy Vehicle Marketplace and NearMe Ads network marketing by email and/or SMS. Service and account messages are not marketing. You can withdraw either consent from Account preferences at any time; a network opt-out always takes priority.

Content

You own the photos and text you post and you licence us to display them for running and promoting the marketplace. Do not post content you have no right to use.

Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law. Beyond what that law requires, we provide the platform as-is and are not liable for dealings between buyers and sellers, or for loss arising from a listing, message or sale conducted through the site.
